1. Acceptance of Terms
By downloading, installing, or using Southport Adventures ("the App," "the Game"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms form a legally binding agreement between you and the developer of Southport Adventures (App ID: com.southport.game). If you are under the age of 13 (or 16 in the EEA), you must have permission from a parent or legal guardian to use the App.
2. Description of the App
Southport Adventures is a single-player, offline text-based role-playing game (RPG) available on iOS (Apple App Store) and Android (Google Play Store). The App:
- Requires no internet connection to play
- Requires no user account or registration
- Stores all game progress locally on your device
- Is free to download and play
- Does not include in-app purchases, loot boxes, or gambling mechanics
3. License to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable, personal license to:
- Download and install the App on devices you own or control
- Use the App for your personal, non-commercial entertainment
This license does not include any rights to sublicense, sell, resell, transfer, assign, or otherwise exploit the App or its content.
4. Prohibited Uses
You agree not to:
- Copy, modify, adapt, translate, or create derivative works of the App
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
- Remove or alter any copyright, trademark, or proprietary notices within the App
- Use the App for any commercial purpose without written permission from us
- Distribute, publish, or make the App available to third parties in any manner
- Use any automated tools (bots, scripts) to interact with the App
- Use the App in any way that violates applicable laws or regulations
5. Intellectual Property
All content within Southport Adventures — including but not limited to the game narrative, characters, locations, dialogue, artwork, sound, code, and the "Southport Adventures" name and logo — is the exclusive property of the developer and is protected by copyright, trademark, and other intellectual property laws.
Southport Adventures is set in a fictional interpretation of Southport, North Carolina. Real place names are used for creative inspiration only. The game is not affiliated with, endorsed by, or connected to the City of Southport or any real persons, businesses, or organizations in Southport, NC.
6. No In-App Purchases
Southport Adventures is completely free to play. There are no in-app purchases, subscriptions, virtual currency, loot boxes, or paid content within the App. Any future premium content, if introduced, will be clearly disclosed and subject to updated Terms.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any bugs or errors in the App will be corrected, though we will make reasonable efforts to do so.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF GAME PROGRESS, OR DEVICE DAMAGE.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP (WHICH, AS THE APP IS FREE, IS ZERO DOLLARS / ZERO UNITS OF LOCAL CURRENCY).
Some jurisdictions do not allow the limitation of liability for personal injury or certain damages; in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
9. Termination
These Terms are effective until terminated. Your rights under these Terms will terminate automatically without notice if you fail to comply with any of its provisions. Upon termination, you must cease all use of the App and delete all copies from your devices.
We reserve the right to discontinue the App or remove it from app stores at any time without notice. Sections 5 (Intellectual Property), 7 (Disclaimer of Warranties), and 8 (Limitation of Liability) shall survive any termination.
10. App Store Additional Terms
Your use of the App is also subject to the terms of the platform through which you obtained it:
- Apple App Store: These Terms are between you and the developer only — not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. To the extent permitted by law, Apple will have no warranty obligation whatsoever with respect to the App. See Apple's standard EULA ↗.
- Google Play Store: Your use of the App is also subject to the Google Play Terms of Service ↗.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation between the parties.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Continued use of the App following any changes constitutes your acceptance of the new Terms.
